Finding help for my dad.  My dad was convicted for a crime that he did not do.  He was tricked by his lawyer into taking a plea.  My father maintained that he was innocent.  My father did not want to take a plea.  My father was charged with rape and he took a plea to misdemeanor sexual battery. He had been in jail three months without a preliminary hearing. My father has a disability.  He is ADHD.  He cannot focus under pressure.  His lawyer was aware of his disability.  My father’s mother made him aware of the disability and the lawyer agreed to consult with her regarding all decisions.  The lawyer went to my father in lock up and told him that he would not have to register as a sexual offender.  He told him that his mother had advised that he take the plea.  The lawyer told his mother that he would not have to register as a sexual offender.  After the 10-day appeal period the lawyer backdated a letter to my father and told him that he had to register as a sexual offender.  My father almost had a nervous breakdown when he found out.  He called his lawyer and his lawyer told him that it was past the 10-day period and there was nothing that my father could do about it.  His lawyer intentionally deceived him into taking a plea that he knew that my father would have never taken if he had been apprised of the consequences of his plea.  He backdated the letter to him after the 10-day appeal period and had it delivered to him in jail.  He stated that he mailed it, but he did not.  It was not postmarked and the jail said that it was delivered.   The lawyer had an agreement with my father that he would keep his mother involved on everything.  He had always sent my father’s mother a copy of every letter that he sent my father on the same day that he sent letters to my father with the exception of the backdated letter.  My father and his mother received that letter on the same date.  My mother’s letter indicated that he had mailed my father’s letter earlier.

The lawyer never told my father that the complaining witness had recanted her statement.  He did not tell him that there were persons who had agreed to come to court to testify that she had recanted her statement.  He did not tell my father that there were people who were with him on the day that he was arrested who would testify that he was INNOCENT.  He did not tell him that his mother had gotten a copy of the complaining witness’ statement and given it to him and what the complaining said did not fit the description of rape. She did not describe threat, force or intimidation.

 

My father’s grandfather had a prosecutor to read her statement and he said that he would not have even made an arrest based on her statement.  The complaining witness lied on my father b/c he would not give her money.

My father’s lawyer had been paid $15,000 up front and he did not want to be bothered with trying the case or even having a preliminary hearing.  He knew that my father was innocent by a preponderance of the evident.  He did not care.  He just did not want to be bothered.      

The complaining witness who had recanted her statement b4 my father was convicted has recently signed a statement that she was not raped.

My father needs help to get his life back on track.

Yes, one good thing may come out of this.  Delegate Joe Morrissey has agreed to present a bill in the Legislature that makes it a law that Judges will have to advise persons of the consequences of their plea.  Thank you Mr. Morrissey for your concern.  This sexual registration is just another way of castrating Afro American men.  My father’s situation was something like the Duke Lacrosse Team incident. Those fellows are getting rich because the prosecutor did the wrong thing, but my dad and his codefendant can’t get any kind of help. e/span>

My father is being told that he cannot have his conviction overturned because he took a plea.  That lawyer did not even tell him to take a “no contest plea.”

My father is innocent.  Being labeled a sexual offender devastates him.  He cannot get a decent job. He has to report to the police within two days after he gets a job.  Then, when he gets a job the police comes to determine if he is on the job and he gets fired.

I want to know if there is anyone out there that knows a lawyer that can help us.  Do you know an honest lawyer that is interested in helping people who cares about the results of his work and his aim is not just to make money. 

My father’s lawyer representation of him was dishonest, deceitful and fraudulent. Do you know a good legal malpractice attorney?

    You should file for malpractice against your dad’s lawyer and have him disbarred. He is s a disgrace to the legal profession.
